Lithgow City Council is publicly exhibiting a draft Housekeeping Planning Proposal (PP-2025-566) that seeks to amend the Lithgow Local Environmental Plan 2014 (LEP 2014) to improve interpretation, accuracy, and overall functionality of the plan. These LEP amendments are being exhibited alongside proposed updates to the Lithgow Development Control Plan 2021 (DCP 2021) to ensure consistency across the local planning framework.
About the Planning Proposal
The Planning Proposal is a housekeeping amendment to the Lithgow LEP 2014 and seeks to achieve the following:
Update Schedule 5 – Environmental Heritage to correct errors, removal of an incorrect listing over 993 Great Western Highway, address omissions, and update significance of newly registered state heritage listings.
Introduce additional LEP provisions relating to:
- Calculation of minimum lot size standards for battle-axe lots,
- Standard Instrument Clause 5.22 - Special Flood considerations,
- Reinstating dwelling entitlements for existing lots or holdings under 4000m2 within RU5 Village zone at Cullen Bullen that can be serviced with reticulated sewer.
Update the land use table for the RU1 Primary Production, RU2 Rural Landscape, RU5 Village zones to permit Artisan Food and Drink Industry with consent.
Permit Recreational Facility (Outdoor) with consent in the C3 Environmental Management Zone.
Correct zoning and land-use anomalies through rezoning of small, site-specific parcels of land and update rural land recently gazetted as part of the National Park estate.
Amendments to the title of the Biodiversity Overlay, Sensitive Lands Overlay and Water Overlay maps to remove reference to Environmentally Sensitive Areas.
Reclassify four Council-owned properties from Community to Operational land:
- Lake Lyell - Lot 1 DP 246233,
- Lake Lyell - Lot 5 DP 1304125,
- Queen Elizabeth Park - Lot 2 DP 1077295, and
- Lithgow Union Theatre - Lot 45 DP 1096536.

A summary of the key changes includes:
Updated flood-related development controls in line with the adopted Lithgow Floodplain Risk Management Study and Plan 2023.
Improved consistency in open space requirements and design considerations for large subdivisions (20 or more lots).
Introduction of development controls for Agritourism.
